Tesla sues EU for tariffs on Chinese BEVs

US EV maker Tesla has reportedly sued the European Union for imposing tariffs on Chinese-made battery electric vehicles (BEVs).

Last October, the European Commission enforced duties of up to 35.3% on BEVs imported from China that will last for five years, Kallanish notes. At the time, Brussels cited “unfair subsidisation which is causing threat of economic injury to EU producers.”

Chinese groups SAIC, Geely and BYD were slapped with tariffs of 35.3%, 18.8% and 17%, respectively, while Tesla was assigned a much lower duty of 7.8% on top of the 10% standard import tariff. 

The Texas-based company has now filed a claim at the European Court of Justice, the Financial Times reports. It joins BYD, Geely and SAIC, the China Chamber of Commerce to the EU, the China Chamber of Commerce for Import and Export of Machinery and Electronic Products, and German carmaker BMW, which had already lodged complaints earlier this month.

"We take note of the cases filed and look forward to presenting our defence in court," says Olof Gill, the Commission spokesperson for trade.

EU imports of Chinese EVs rose by more than ten-fold in value terms between 2020 and 2023, according to the Center for Strategic & International Studies.
