Brazilian foreign trade chamber, Camex, has dismissed a request from ArcelorMittal, CSN and Gerdau to reapply anti-dumping measures on imports of hot rolled coil originating from China, expiring on 21 May 2023. This is according to a note published last week at the country’s Official Gazette, Diário Oficial da União, Kallanish notes.
Brazil imposed both AD measures and countervailing duties on Chinese HRC for a period of up to five years in 2018.
Nevertheless, these were never applied for reasons of public interest, which is a mandatory assessment in anti-dumping or subsidy investigations in Brazil since April 2019.
The trade chamber considers that, in the last years of suspension of such measures, no relevant changes were recorded in the analysis of previous public interest assessments.
“On the contrary, there is uncertainty about the continuity of imports from Russia and Ukraine, alternative sources relevant to the Brazilian market, and imports from Chinese origin became more important in relation to the total at the end of the analyzed period,” Camex explains. “Thus, a possible restriction on China's imports through the reapplication of the compensatory measure would generate more significant risks to the downstream chain than those identified at the time of the suspension recommendation.”
The petitioners' request to reapply AD measures covered flat-rolled products, of alloy or non-alloy steel, of a width equal to or greater than 600mm, hot-rolled, in sheets of thickness less than 4.75mm, or in coils of any thickness. These are classified under HS codes: 7208.10.00, 7208.25.00, 7208.26.10, 7208.26.90, 7208.27.10, 7208.27.90, 7208.36.10, 7208.36.90, 7208.37.00, 7208.38.10, 7208.38.90, 7208.39.10, 7208.39.90, 7208.40.00, 7208.53.00, 7208.54.00, 7208.90.00, 7225.30.00 and 7225.40.90.
The companies involved in the investigation were Chinese Hebei Iron & Steel, Bengang, Baosteel and Maanshan Iron & Steel Company.
